Question 1

Do I really need a permit for a container home?

Accepted Answer

If you are going to live in it, yes. Since 1 October 2026 the law says a building is anything fixed to the land with a degree of permanence, “whatever the construction system”. Being modular, prefabricated or removable does not exempt it. The courts and the National Territory Commission (Comissão Nacional do Território) take the view that setting the house down without foundations or putting it on wheels changes nothing when it is used as a home. Before you buy the land or the container, file a prior information request (PIP) with the câmara.

Question 2

Is there a simpler route than a licence?

Accepted Answer

The lightest route is prior notification (comunicação prévia). It applies to plots in an approved subdivision (loteamento), a detailed plan (plano de pormenor) or a consolidated urban area, when the project follows the rules already set for the site. There is no approval decision: you pay the fees, notify the câmara and start, and the câmara checks afterwards, for one year. The project and the qualified professionals are still mandatory. With no control at all, only small annexes next to an existing house are allowed (up to 10 m² and 2.2 m high, or whatever your câmara’s regulations allow). Bungalows and mobile homes only have their own regime inside licensed campsites, as tourist accommodation. There is currently no catalogue of pre-approved modular houses.

Question 3

What changed in planning permission in October 2026?

Accepted Answer

The revised Legal Regime for Urbanisation and Building (RJUE, DL 108/2026) came into force on 1 October 2026. Use of the building after the works now goes through prior notification (there is no longer a use permit to apply for), the câmara’s follow-up control drops from 10 years to 1 year, and prior information requests get short deadlines with tacit approval. The 2024 Simplex rule stays: when the work fits prior notification, you cannot choose the licence route instead. In practice more responsibility moves to whoever builds and to the professionals who sign. Always confirm the procedure with your câmara: the new rules are still being fine-tuned council by council.

Question 4

Can a single container be licensed as a house?

Accepted Answer

Under the minimum areas of the RGEU, which remains the reference until the new technical regulation comes out, a T0 (studio) needs about 35 m² of gross area and a T1 (1 bedroom) 52 m². A 40′ HC has about 30 m². Two 40′ HC reach T1 and three reach T2. A single container works as an annex, office or holiday home where the PDM allows it, but it is unlikely to pass as a dwelling. Always confirm with the câmara and an architect.

Question 5

How long does it take from container to house?

Accepted Answer

The build itself can be quick: weeks to a few months. What usually takes time is the project and the câmara, which can take several months.

Question 6

Used or one-trip container?

Accepted Answer

A used 40′ HC costs around €2,000–2,700 with IVA; a one-trip one costs close to double. For a home, used only if grade A and after an inspection: structural rust, the floor (often treated with chemicals) and the door seals. The price difference barely matters in the total: the container is between 7% and 15% of the bill.

Question 7

Is it cheaper than a conventional build?

Accepted Answer

Per m², not always. The container is only a small part of the bill. The real saving comes from a shorter build and a simple plan, not from the price of steel.

Question 8

Can I put a container in the garden as an office or a short-term let?

Accepted Answer

It depends on the use, the size and the municipality. For a short-term let (alojamento local) or permanent use, expect prior control. Check with your câmara before you go ahead.

Question 9

What does the calculator estimate include?

Accepted Answer

Containers, transport, foundations, cuts, insulation, windows, services, bathroom, kitchen, furniture and project with fees, VAT included and a ±15% margin. It never includes the land.
